Terms of Service

Welcome to Pip's Pairs: Talking Match (the "App"), made by Gizmotron LLC ("we", "us", or "our"). These Terms of Service ("Terms") cover your use of the App and this website. By downloading, installing, or using the App, you agree to these Terms.

1. Acceptance of these Terms

By using the App or this website, you agree to be bound by these Terms. If you are a parent or guardian downloading the App for a child, you are agreeing to these Terms on that child's behalf, and you are responsible for their use of the App.

2. License to use the App

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own personal, non-commercial use. This license is conditioned on your compliance with these Terms. All rights not expressly granted to you are reserved by Gizmotron LLC.

3. Acceptable use

You agree not to:

• Copy, modify, reverse-engineer, decompile, or create derivative works of the App, except to the extent applicable law expressly permits this despite this restriction
• Remove, obscure, or alter any proprietary notices in the App
• Use the App in any way that violates applicable law, or that attempts to interfere with, disrupt, or gain unauthorized access to the App, our systems, or other users' devices
• Redistribute, sell, rent, lease, sublicense, or otherwise make the App available to third parties outside of the distribution channels we authorize (such as Google Play or the App Store)

4. Intellectual property

The App, including its game design, artwork, characters, sound, code, and the Pip's Pairs: Talking Match name and logo, is owned by Gizmotron LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership of the App or its content to you.

5. Third-party app stores

The App is distributed through third-party app stores such as Google Play (and, where applicable, the Apple App Store). Your download and use of the App is also subject to the terms of service of the store you downloaded it from. Those stores are solely responsible for providing support related to their own platforms; we remain responsible for the App itself.

6. In-app purchases

If the App offers optional in-app purchases, all purchases are billed and processed by the app store you downloaded the App from (for example, Google Play), and its payment terms and refund policies apply. We never see or store your payment card details. Purchases that unlock App content are tied to the account or device used to make the purchase, as governed by that store's own restore-purchase mechanism.

7. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by applicable law. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

8. Limitation of liability

To the fullest extent permitted by applicable law, Gizmotron LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of, or inability to use, the App, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the App will not exceed the amount you paid us, if any, for the App in the twelve months before the claim arose.

9. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice (such as an in-app notice). Continuing to use the App after a change takes effect means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles, except to the extent applicable consumer-protection law in your country of residence provides otherwise.
